2. Eligibility
You must be at least 18 years old to use this Service. By using FitCheck, you represent and warrant that you have the right, authority, and capacity to enter into this agreement.
3. User Accounts and Content
3.1 Account Responsibility
You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account.
3.2 User Content
By uploading photos ("User Content") to FitCheck, you grant us a non-exclusive, royalty-free, worldwide license to use, process, and store your content solely for the purpose of providing the virtual try-on service. You represent that you own or have the necessary rights to use the photos you upload.
3.3 Prohibited Content
You may not upload content that is:
- Illegal, pornographic, or offensive
- Infringes on the intellectual property rights of others
- Contains viruses or harmful code
4. Nature of AI Output
4.1 Variability and Accuracy
You acknowledge that FitCheck utilizes advanced artificial intelligence (Google Gemini) to generate images. AI-generated content is probabilistic in nature. We do not guarantee:
- That the results will be 100% accurate or represent a perfect likeness
- That the quality of generation will remain consistent, as AI models and underlying technology are subject to updates and changes
- That the output will be free of visual artifacts or "hallucinations" common to generative AI
4.2 No Professional Advice
Virtual try-on results are for illustrative purposes only and should not be taken as professional fashion, sizing, or fit advice. Actual garment fit may vary from the digital representation.
5. Subscriptions and Payments
5.1 Chrome Extension
Payments for the Chrome Extension are processed via Stripe. Subscriptions are billed on a recurring basis as described at the time of purchase.
5.2 Shopify Plugin
Payments for the Shopify Plugin are handled through Shopify Billing. Merchant plans are subject to Shopify's terms and conditions.
5.3 Refunds
Refund policies are handled according to the platform through which the purchase was made (Stripe or Shopify).
6. Intellectual Property
The technology, AI models, and software behind FitCheck are the property of FitCheck and are protected by copyright and other intellectual property laws. You may not attempt to reverse engineer or scrape our Service.
7. Disclaimer of Warranties
The Service is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not guarantee that the AI-generated results will be 100% accurate or photorealistic.
8. Limitation of Liability
In no event shall FitCheck be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Service.
